The facts in this case are not in dispute. Carl Gustaf Bengtson died intestate on June 6, 1887. He was survived by his wife, Ellen, and four children, Henning, Esther, Johan, and Carl, ranging in age from two to eight years. Decedent was the owner in fee of a half section of land in Lyon county, the south half of the southwest quarter of which was the family homestead, upon which decedent and his family then and for many years had resided.
