O’KELLEY, Chief Judge.

This case is presently before the court for consideration of the defendants’ motions to dismiss and for summary judgment, and the plaintiffs’ motions to withdraw admissions and for leave to file a supplemental brief. On January 26, 1989, the court heard oral argument on all motions save the motion to file a supplemental brief, after which it took the matters under advisement.
