McKAY, Circuit Judge.

The issue in this case is whether plaintiff, lessee under several oil and gas leases, has the exclusive right to conduct geophysical explorations on the land subject to the leases.

The leases at issue cover tracts of land located in Kansas and Oklahoma. Plaintiff filed actions against defendant Texaco in both states, seeking damages and an accounting on the ground that defendant had conducted geophysical explorations on land covered by plaintiffs leases without plaintiffs consent.
