A Hampden County grand jury indicted Donald B. Whitlock for unlawful distribution of cocaine within 1,000 feet of a school (no. 92-1202) (G. L. c. 94C, § 32J). A second indictment (no. 92-1203) arising out of the same episode, charged him as a repeat offender under G. L. c. 94C, § 32A(c) & (d). Just after the jury were sworn, the session clerk inadvertently read them the allegation of a *515“second offense” contained in the second indictment.
