The complaint in this case alleges, in substance, that in April, 1901, the plaintiff obtained a loan from the defendant of $500 on a fraudulent representation that a placer mining claim, which he had in Alaska, was abundant security for the said sum, and that the claim was a developed claim and was producing gold and would produce gold in large amounts; that said representations were *266false and fraudulent, and were known by the defendant to be false and fraudulent when he made them; that plaintiff did not know at said time, and has only recently learned, that such representations were false…
