*942On March 20, 1997, the defendant pleaded guilty to sexual abuse in the first degree. On June 18, 1997, he was sentenced to six months’ incarceration concurrent with five years’ probation and remanded to serve his sentence. After the defendant’s release from prison, the matter was referred to this court for a determination of the defendant’s risk level pursuant to the Sex Offender Registration Act (Correction Law § 168 et seq.). The Board of Examiners of Sex Offenders has failed to provide this court with a recommendation as to the defendant’s risk…
