Defendant was convicted on June 19, 1996 after a jury trial of one count of sodomy in the first degree (Penal Law § 130.50 [2]) and one count of falsifying business records in the first degree (Penal Law § 175.10), based upon events occurring in 1995. On the consent of the People, defendant was released on *147bail pending sentence. On September 6, 1996, defendant was sentenced on the first count to a term of incarceration of 31/3 to 10 years and on the second count to a term of imprisonment of l1/3 to 4 years, each term to run concurrently with the other.…
