This case presents error from the district court •of Carter county. The defendant in error as plaintiff begun its action to recover from plaintiffs in error on certain promissory notes given as part of the purchase price for certain lands described in a deed dated May 20, 1908, upon which a lien was retained as security for the payment thereof. To this petition ■defendants in their amended answer admitted the execution of the notes sued on for the purposes and consideration set forth in plaintiff’s petition, but they denied any indebtedness to plaintiff for the reason that the lands purchased…
