Defendant was convicted of the crime of making a felonious assault with a revolver upon one Albert Davenport, without' intent to commit the crime of murder or to inflict great bodily harm less than the crime of murder, and was fined $200 and $50 *122costs with the alternative of 6 months” confinement in jail. The case is here by writ of error.
