THIS MATTER is before the Court on the Defendant’s motion to transfer this action to the Middle District of Florida, Orlando Division, pursuant to 28 U.S.C. § 1404(a). That section provides:
For the convenience of parties and witnesses, in the interest of justice, a district court may transfer any civil action to any other district or division where it might have been brought.
The decision whether to transfer a case under § 1404(a) rests in the discretion of the District Court. Akers v. Norfolk & Western Railway Co., 378 F.2d 78, 80 (4th Cir.1967).
