HODGE, District Judge.

Plaintiff in this action sought to recover damages for alleged malicious prosecution and false imprisonment; and for his costs and a reasonable attorney’s fee. The case was tried before a jury. At the conclusion of the plaintiff’s evidence the Court sustained a motion of the defendant for judgment of dismissal as to any cause of action for malicious prosecution; and the case was thereafter submitted to the jury upon the issue of false arrest or imprisonment.
