DeMOSS, Circuit Judge:

On May, 8, 1996, Michael Dewayne Johnson was convicted of, and received the death penalty for, the 1995 murder of Jeff Wetterman. The Texas Court of Criminal Appeals affirmed the conviction and sentence in an unpublished opinion, and the United States Supreme Court denied cer-tiorari on May 18, 1998. Johnson filed a state application for habeas relief in the trial court, which was denied on February 18, 2000, after a hearing was held.
