DAVIS, Justice.

W. L. Dyess, plaintiff-appellee, sued George C. Vaughan & Sons, a corporation, appellant-defendant, for personal injuries alleged to have been sustained at appellant’s place of business as a result of falling from a wooden scaffold built by appellant’s employees when a 2x4 piece of lumber used in such scaffold broke under the weight of appellee.
