This is an appeal from a judgment of the circuit court adjudging the plaintiff entitled to recover from the defendant his costs and disbursements in this action. By his complaint the plaintiff sought to recover a certain sum therein specified for the alleged failure of the defendant to deliver in good order and condition certain freight, consisting of fire brick and tiles, shipped by plaintiff over the defendant’s railroad.
