The appellant, Robert G. Holway (the "contestant"), filed in the trial court, pursuant to Ala. Code 1975, § 43-8-199, a contest of the probate of the last will and testament of Mary Eileen Holway, his mother (the "mother"), against his sister, Margaret Catherine Wanschek (the "executrix"), and against his other sister, Jean Ann Whitney, and against his brother, Timothy Kevin Holway (the "other two siblings").
