This is an appeal from a denial of a petition for a writ of habeas corpus filed under 28 U.S.C. § 2254. Early on the morning of September 1,1977, Robert Brown hit the cashier of a gasoline station on the head and knocked him to the floor. After robbing the station, Brown kicked the attendant, threatened to kill him and shot him twice. Brown was convicted of robbery in the Circuit Court of Tuscaloosa County, Alabama.
