This is an appeal from a “Judgment and Sentence” in a ease wherein the appellant was found guilty of a violation of section 288, Penal Code, and from an order denying a motion for a new trial.

Defendant, Nothnagel, was charged in an information with two counts of violation of section 288, Penal Code, and with two prior convictions; namely one for forgery and one for escape from a state prison. Nothnagel admitted the prior convictions and pleaded not guilty. A jury found him guilty of Count II as charged in the information.
