MEMORANDUM OPINION

FIELD, Chief Judge.

This diversity action was instituted by the plaintiff, National Lead Company, a New Jersey corporation (hereinafter referred to as “National”), against the defendant, Kanawha Block Company, a West Virginia corporation (hereinafter referred to as “Kanawha”), and involves a controversy relative to an easement or right of way granted by the plaintiff to the defendant incident to the conveyance of certain real estate.
