Harriet L. Shaver brought an action of trespass on the case against Thomas B. Edgell in the circuit court of Harrison County to recover damages for trespass by entry on the land of the plaintiff,, in which a jury found one cent damages for the plaintiff subject to a demurrer by the plaintiff to the defendant’s evidence, which demurrer the court decided in favor of the plaintiff, and rendered judgment for the plaintiff. The defendant filed pleas setting up that he was justified in entering the plaintiff’s close by reason of a right of way vested in him. The defendant sued out…
