James M. Murray died July 23, 1926. On September 26, 1923, he had taken out a policy of life insurance in which the G. F. Higgins Company, designated as his “employers,” was named beneficiary. On the death of Murray, the insurance company paid the amount of the policy to the beneficiary and the executrix of decedent subsequently instituted this action against the beneficiary to recover the amount so paid. Plaintiff’s claim is based on the theory that the G. F. Higgins Company had no insurable interest in the life of Murray. The trial judge held otherwise, and from…
