This is the second appearance of this case in- this court. Turner v. Davidson, 183 Ga. 404. This court there held that the verdict in favor of the defendant was erroneous, in that the evidence demanded a verdict for the plaintiff, and accordingly granted a new trial. The defendant thereafter amended his answer, the case was retried, and a verdict in favor of the defendant was again returned.
