I.( BACKGROUND

On July 6, 1999, Defendant Juan Soto (“Defendant”) was indicted by the Grand Jury and charged with one count of possession with intent to distribute more than five grams of cocaine base (“crack”) and one count of possession with intent to distribute cocaine powder, in violation of 21 U.S.C. § 841(a)(1), as well as criminal forfeiture under 21 U.S.C. § 853.
