Plaintiff in error, Rudolph Lederer, began suit in the circuit court of Cook county against defendant in error, the Railway Terminal and Warehouse Company, to recover damages for the loss of certain cases of whisky which were destroyed by fire. The declaration consisted of five counts. The first two were in bailment and set up the delivery of the whisky in good condition to defendant in error for safe keeping, the agreement to re-deliver the same on demand, the duty to exercise reasonable care for its safe storage, and its loss and destruction through defendant in error's negligence.
