I. INTRODUCTION
This matter comes before the court on the defendants’ motion to dismiss the plaintiffs’ amended complaint. The plaintiffs, Samuel Franco, Nathan Franco, Allen Franco, and D Mart (collectively, “the plaintiffs”) filed suit pursuant to 42 U.S.C. § 1983 seeking declaratory judgment, an injunction and damages.
