Plaintiff Essex Insurance Company brought this declaratory judgment action to determine whether it is obligated to provide insurance coverage for a claim filed against its insured, H & H Land Corporation. Essex has also brought a claim for indemnity against the McNeal Agency, to the extent that it is hable to H & H. Before the Court are motions for summary judgment filed by Essex (Doc. 42) and by the McNeal Agency (Doc. 41).
