In a proceeding pursuant to CPLR article 78, inter alia, to compel the appellants to issue a building permit, the appeal is from an order and judgment (one paper) of the Supreme Court, Orange County (Nicolai, J.), dated February 1, 1988, which denied the appellants’ motion to dismiss the proceeding on objections in point of law and granted the petition to the extent of directing the appellants to issue a building permit to the petitioner.
