The appellee corporation, organized in 1851 under a charter which was made a public law, procured its right of way, including that at the Ashley crossing hereinafter referred to, in 1852, and has been in its possession since that date, its road being completed to Ashley, in Washington county, in 1854. In 1869 the St. Louis and Southeastern Railivay Company was incorporated, and built a railroad from a point in Illinois opposite the city of St. Louis, to Shawneetown, Illinois, via McLeansboro, which crossed the railroad and right of way of appellee at Ashley, where appellee’s right of way is…
