This case presents two interesting and somewhat novel issues of copyright law. The first is whether The Seinfeld Aptitude Test, a trivia quiz book devoted exclusively to testing its readers’ recollection of scenes and events from the fictional television series Seinfeld, takes sufficient protected expression from the original, as evidenced by the book’s substantial similarity to the television series, such that, in the absence of any defenses, the book would infringe the copyright in Seinfeld.
