Sterrett, plaintiff below, by his next friend, Minnie L. Sterrett, brought suit against appellant and Angus MacDonald and Robert McKenzie, as defend- . ants, to recover damages in the sum of fifty thousand dollars, claimed to have been sustained by the joint and concurring negligence of these parties. The individual defendants demurred to the complaint upon the ground that it did not state facts sufficient to constitute a cause of action against them, or either of them.
