Suit was instituted in the Seventeenth district court of Tarrant county, Tex., by C. L. Pace against the Missouri, Kansas & Texas Railway Company of Texas for damages for personal injuries sustained. Plaintiff alleged that on the 24th day of February, 1913, he was an employé of defendant railway company in the capacity of locomotive engineer, and as such was operating one of appellant’s engines attached to a string of cars which were to be carried south from Ft.
