The only issue in this action of contract to recover a real estate broker’s commission is whether the defendant engaged the services of the plaintiff for the sale of his property and to pay him for his efforts.
The evidence tends to show that the defendant was the owner of certain real estate in New Bedford which he wished to sell. The plaintiff, a mill worker, and the defendant who had known each other for many years discussed the matter of sale.
