LYNCH, Circuit Judge.

This appeal arises from the aftermath of our decision in Mangual v. Rotge-Sabat, 317 F.3d 45 (1st Cir.2003), which resolved some but not all of the claims against the constitutionality of Puerto Rico’s criminal libel statute presented by the plaintiffs in the initial litigation.

The district court construed oúr remand order and mandate to preclude it from considering additional legal claims of the original plaintiff, Tomas de Jesus-Mangual, and the intervenor Jorge Medina that the statute is also unconstitutional as applied in a different context. As a result, it refused…
