The evidence shows that in the fore part of March, 1914, one George W. Gardner held a lease upon and conducted the Harvard Hotel in Denver; that the furniture and personal property in the hotel belonged to him, and was worth some fifteen or twenty thousand dollars, upon which the owner of the building held a chattel mortgage to secure the payment of a note for $5,100.00, and to whom he also owed some eighteen hundred or two thousand dollars for rent then due.
