MEMORANDUM OPINION AND ORDER

SHADUR, District Judge.

Federal Deposit Insurance Corporation (“FDIC”) and Seattle-First National Bank (“S-F”) initially sued James and Ann Linn (collectively “Linns”), ASA Energy Corporation (“ASA”), Red Stone Energies, Ltd. (“Red Stone”) and Cobra Drilling, Inc. (“Cobra”) to collect amounts allegedly due on two promissory notes (the “Notes”) executed by Linns and on limited recourse guaranties (the “Guaranties”) executed by ASA, Red Stone and Cobra. Defendants then filed counterclaims against FDIC and S-F and joined Continental Illinois National Bank and Trust…
