Ross H. Cutter was clerk of the courts of Erie County from 1916 until his death in 1922. At one time he kept a personal account in the bank with which he dealt, but prior to 1921, and thereafter, all of his deposits were made as “clerk of courts.” The county controller of Erie County has no statutory right to audit the accounts of such officer, though he had the power of county auditors to adjust annually the affairs of other officials, as fixed by the Act of April 15, 1834, P.
