OPINION

GAULTNEY, Justice.

This is an appeal from the dismissal of appellant Anthony Wayne White’s lawsuit pursuant to Chapter 14 of the Texas Civil Practice and Remedies Code.1

WThite, a prison inmate, sued the State of Texas, the Texas Department of Criminal Justice — Institutional Division (“TDCJ”), and three TDCJ employees for causes of action under the Texas Tort Claims Act (Tex. Civ. & PRAC. Rem.Code Ann. §§ 101.001-101.066 (Vernon 1997 & Supp. 2001)) and for alleged violations of 42 U.S.C. § 1983 (Supp.2000).
