Josephine Mora (“Plaintiff’) sued her former employer, Jackson Memorial Foundation (“Defendant”) for wrongful termination under the Age Discrimination in Employment Act (“ADEA”). 29 U.S.C §§ 621-34. The district court granted summary judgment to Defendant because the court concluded that Defendant would prevail under a “same decision” affirmative defense.
