ROGERS, Circuit Judge.

This is an appeal from an order dismissing a writ of habeas corpus, which had been granted to inquire into the *208legality of the detention at Ellis Island, by the immigration officials, of one Nicolo Devenuto as an immigrant alien, who had been denied the right to enter the United States and was about to be deported, it is alleged, in violation of his rights.

It appears that Devenuto is a native of Italy, 33 years of age, and married. He is a stone mason by trade.. He arrived at the port of New York by the steamship Conte Rosso, on June 14, 1923. He was examined before a…
