Defendant has moved to dismiss this action, which was transferred to this court by the United States District Court for the District of Montana, for lack of jurisdiction over plaintiffs claims for (1) damages for breach of a contract of which it claims to be a third-party beneficiary, (2) imposition of a constructive trust to prevent unjust enrichment, and (3) declaratory judgment. See Montana v. United States, No. 91-95-BLG-RWA, 1995 WL 376538 (D.Mont. Oct. 7, 1993). Plaintiff opposes this motion and, in the alternative, requests transfer back to the district court,…
