I. INTRODUCTION
On August 30, 2013, in accordance with the discovery schedule, plaintiffs served their expert report on the remaining de*456fendant in this case, Derek Palaschuk. On September 4, 2013, Palaschuk served a report authored by his own expert, Alan D. Bell. Plaintiffs moved to exclude Bell’s report and testimony on November 20, 2013. The same day, Palaschuk moved for summary judgment1.
