Appeal from Monroe District Court. — Hon. H. C. Traverse, Judge. This appeal is from an order requiring the .clerk of the district court to pay to the plaintiff certain money.

In the year 1886 the plaintiff, Peterson, recovered in the district court of Monroe county, against the defendant, Hays, and another, judgment for the sum of eight hundred and twelve dollars and twenty-three cents. Afterwards there was paid to Grriffin, as clerk of that court, to apply on the judgment a sum sufficient to pay the costs and leave a remainder of six hundred and eighty-four dollars and sixty-five cents.
