Appeal from Boone District Court. — Hon. J. L. Stevens,, J udge. Action to recover an amount alleged to' be due to-the plaintiff for personal services rendered on account of the defendant. A’jury was impaneled to try the cause, but the court took the case from the jury, and rendered judgment in favor of the defendant. The plaintiff appeals.

The petition alleges that from the year 1867 until about the year 1885 the plaintiff was employed by, and rendered services for, the defendant in loaning and collecting money, and in renting and selling houses, and in collecting rents, of the value of seven hundred dollars, no part of which has been paid. The answer denies the alleged employment and indebtedness, and pleads a settlement; also a prior adjudication; and that the action is barred by the statute of limitations.
