The plaintiff, Daniel K. Cox, commenced this action alleging that he had been laid off from his employment with the defendant department of social services (department) in violation of General Statutes § 5-241. The defendant Elizabeth Aiken, assistant director of human resources for the department, and the department, filed a motion to dismiss the action, claiming that the trial court lacked subject matter jurisdiction over the action.
