Plaintiffs, the Patrolmen’s Benevolent Association of the City of New York, Inc. (PBA) and its president, Patrick Lynch, challenge defendants’ interpretation and application of the Child Care Credit Law for certain of its members. On behalf of the PBA and the police officers who have been or may be aggrieved in the future, they move for an order: (i) pursuant to CPLR 3215, for a default judgment against defendants; and (ii) pursuant to CPLR 3212, for summary judgment and declaring that all police officers hired by the New York City Police Department…
