MIKVA, Chief Judge:
On September 1, 1983, a Korean Air Lines (“KAL”) Boeing 747 airliner was shot down somewhere over the Sea of Japan by one of the Soviet Union’s military aircraft, killing all 269 persons on board. The flight recorders and most of the wreckage were never recovered, so the exact details of what happened remain a mystery. Numerous wrongful death suits were filed against various defendants including KAL and the United States.
