LOCKWOOD, Vice Chief Justice.

The State of Arizona, on the relation of Charles N. Ronan, Maricopa County Attorney, instituted this original proceeding in certiorari against the Superior Court of Maricopa County and Maryland National Insurance Company to test the jurisdiction of that court to vacate a bond forfeiture.

This matter arose out of a criminal action against Foster Burchett, charging him with the crime of forgery. His preliminary hearing was set for June S, 1963, in the Justice Court of West Phoenix Precinct, Maricopa County. On May 23, 1963, he was released on a bail bond posted by…
