The defendant was charged by information with murder in the first degree, the killing of one Lizzie Morrow in Harrison County. On a trial in the Circuit Court of Grundy County on change of venue he was convicted and his punishment assessed by a jury at imprisonment for life in the State penitentiary. He appeals bringing up an incomplete bill of exceptions which sets out the testimony of only four witnesses, under authority of the concluding proviso of Section 3756, Revised Statutes 1929.
