In the Circuit Court of Cape Girardeau County, defendant was convicted of murder in the second degree and sentenced to forty-three years' imprisonment in the penitentiary, from which he appeals. One B.M. Hargett was murdered at Chaffee, in Scott County, on October 17, 1927. Appellant and two others, Coy Lasley and George Fowler, were jointly indicted for the crime, the indictment charging murder in the first degree, and upon their application were granted a change of venue to the Circuit Court of Cape Girardeau County, where Lasley and Stogsdill filed affidavits disqualifying the regular…
