DE HAVEN, District Judge.
This proceeding was commenced by the owners of the steamer Arctic Bird and a certain barge to obtain the judgment of the court that they are not liable for any damage caused by the sinking of the barge referred to, and the loss of goods and merchandise carried thereon at the time, or, in the event that it shall be determined that they are not entitled to such relief, then for a judgment limiting their liability to the amount of the value of the interest of such owners in the steamer and barge and in their freight then pending.
