This case asks how the government should determine whether certain for-profit and vocational schools “prepare [their] students for gainful employment in a recognized occupation.” 20 U.S.C. §§ 1002(b)(1)(A)®, 1002(c)(1)(A). The Department of Education proposes one answer: it plans to measure the average debt load of a program’s former students against their earnings.
